The core argument: that distributing eyewear with embedded cameras constitutes a breach of Germany's Telecommunications, Digital Services, and Data Protection Act. The complaint frames the devices not as consumer electronics but as covert surveillance tools that fall outside existing regulatory guardrails.
The legal maneuver reflects a broader unease across Europe about wearable cameras. Unlike smartphones, which require deliberate positioning and a visible screen, smart glasses sit at eye level and record with minimal physical cues. The LED Indicator and Its Workarounds

In practice, third-party sellers have begun offering accessories that diffuse or redirect the LED's glow without triggering the anti-tampering logic. These workarounds are not difficult to find, and their existence underscores a familiar dynamic: hardware safeguards invite hardware countermeasures. The result is an escalating cycle where each new control prompts a corresponding bypass.
The Bystander Consent Gap
The more fundamental issue lies in who holds the power to consent. Privacy settings on smart glasses primarily govern what the wearer can do with captured content - whether to store it locally, upload it to the cloud, or share it. But those settings do nothing for the people who appear in the frame. Bystanders have not reviewed Meta's terms of service, have not opted into data collection, and in many cases may not recognize that the eyewear in front of them contains a camera at all.
This is not an edge case. As these devices become more common, the probability that any given person will be recorded without knowledge or agreement rises. One developer attempted to build a countermeasure: an app that alerts users when a pair of smart glasses is nearby. The tool relies on detecting the Bluetooth signature of the devices, offering a kind of early-warning system for those concerned about being recorded. Whether such an app can scale, or whether Meta will adjust its hardware to make detection harder, remains an open question.
This is the shape of the arms race HateAid's complaint is trying to pre-empt. Each technical safeguard invites a workaround; each workaround invites a new safeguard. In the meantime, the default posture shifts: recording becomes ambient, consent becomes implicit, and the burden of protecting privacy falls increasingly on those who did not choose to wear the device.

Germany's data protection framework is among the strictest in the world, and HateAid's complaint is a direct test of whether those rules can extend to wearable hardware.
