Chinese Studios Are Paying Strangers to License Their Faces for AI Content
A new marketplace lets anyone sell their likeness for $15 to $700 per production, but legal experts warn the platforms cannot prevent long-term misuse of biometric data.

A New Trade in Biometric Identity
The generative AI wave has opened an unexpected marketplace in mainland China: platforms where anyone can list their face for rent. Producers of AI-generated dramas and commercials browse catalogs of faces sorted by age, gender, or archetype ranging from "girl-next-door" to "rugged" or "supermodel." Users upload images, set their own licensing fees between $15 and $700, and specify which genres or product categories their likeness may appear in.

The platforms frame the arrangement as a win: ordinary people monetize an asset they already possess, and producers access diverse faces at lower cost than hiring actors. Yet the mechanics of these deals and the opacity of downstream usage raise questions that neither the platforms nor China's evolving legal framework have fully answered.
Why Studios Want Real Faces
AI-generated short dramas have exploded across China's mobile internet. According to industry data, more than 95 percent of the 128,000 microdramas released in the first quarter of 2026 incorporated AI in production. Microdramas are ultrashort, vertical-format series optimized for smartphone screens and designed for rapid consumption. The sector has grown into a multibillion-dollar industry, fueled by low production costs and high viewer engagement.
However, audiences have begun to complain that AI-generated characters look monotonous. Social-media users note that many productions feature visually similar faces, eroding differentiation and viewer interest. ByteDance's AI drama platform Hongguo announced a crackdown on homogeneous face usage in July, signaling that even large platforms recognize the problem.
Studios need variety. Lead roles demand conventionally attractive faces, but supporting casts require distinctive features: elderly characters, weathered faces, or niche archetypes that purely synthetic models struggle to generate convincingly. Long Lyu, operations lead at New Claw, an AI image rights platform based in Chengdu, told reporters that traditional drama production has declined sharply since late last year as advertising budgets shifted toward AI-generated content. The economics are straightforward. Licensing a static face costs a fraction of hiring an actor for a day's shoot. New Claw has set a floor price of 500 yuan (approximately $74) per image to prevent a race to the bottom. ActID, a Shenzhen-based competitor that launched in March, charges between 99 and 500 yuan per episode and takes a 10 percent commission. Around 800 users have registered with ActID since launch, and roughly 300 have agreed to license their images. So far, two AI drama productions have licensed about ten faces through the platform.
The Intellectual Property Battlefield
The rise of face licensing follows a wave of unauthorized use cases. Ordinary people, not just celebrities, have discovered their faces starring in AI dramas they never consented to. ByteDance removed more than 85,000 videos featuring unauthorized AI-generated faces and voices in the first half of 2026 alone. Two influencers accused Hongguo of stealing and altering their likenesses without permission; the resulting minidrama, which accumulated over 40 million views, was eventually taken down.
The Guangzhou Internet Court has heard approximately 700 AI-related face-theft cases over the past three years, according to National Business Daily. In March, the Beijing Internet Court issued a landmark ruling that using a person's likeness in AI-generated face swaps without authorization is illegal, even when the image has been modified. Chinese state media framed the decision as an important precedent, establishing that digital alteration does not exempt producers from liability.
ActID positions itself as a solution to this legal minefield. The platform helps users draft licensing agreements and monitors the internet for unauthorized use of registered faces. When violations occur, ActID connects users with lawyers who can pursue legal action. Camille Yan, ActID's chief marketing officer, emphasized that producers seek both attractive and distinctive faces. "AI-generated dramas don't require acting ability anyway," Yan explained. "The faces serve as source materials."
Yet the platform model raises as many questions as it answers. Contracts often contain vague authorization clauses. Yile Deng, a Beijing-based lawyer specializing in AI-related portrait rights cases, acknowledged that the emergence of a business model for selling facial image rights represents progress toward establishing commercial and legal frameworks. Still, she warned that the platforms cannot eliminate broader risks. "The most apparent problem remains the unclear scope of authorization," Deng said. "Many agencies are still paying people just a few dozen dollars to collect facial data. But when you examine the contracts closely, the licensing terms are often so vague that it's impossible to know who will ultimately use the likeness, or for what purpose."
Biometric Data and Long-Term Control
Once facial data enters an AI marketplace, users may effectively lose long-term control over how their biometric identity is used. The platforms cannot prevent unauthorized face-swapping, illegal data collection, or future AI training using the uploaded images. Even if a user licenses their face for a single drama series, that data may propagate across training datasets, derivative works, or unauthorized productions beyond the platform's monitoring reach.
Xu Fang, a 21-year-old Shanghai-based model, filed a legal claim against a Chinese fashion brand after alleging it used his face on products he never modeled. Despite the promise of new income streams, Fang said he would never sell the rights to his own face. "If I license my face, I have no idea how AI might eventually change it or whether it could portray me in degrading ways," he told reporters.
Fang's concern points to a deeper issue: the asymmetry of information and power between individuals and the production ecosystem. A person who uploads their face receives a one-time or per-production payment, but the downstream value chain, including model fine-tuning, derivative content, and secondary licensing, remains opaque. The platforms offer monitoring and legal support, but enforcement depends on detection, which is imperfect, and legal action, which is costly and slow.
The risk extends beyond commercial misuse. Biometric data, once digitized and distributed, can be repurposed for surveillance, identity fraud, or other applications far removed from the original licensing agreement. China's regulatory environment around biometric data is evolving, but enforcement remains inconsistent, and cross-border data flows complicate jurisdictional oversight.
Producer Skepticism and Cost Pressures
Not all AI drama producers are convinced that licensing real faces is worth the expense or legal complexity. Wendi Ma, an AI drama director, noted that some productions purchase faces to make characters appear less synthetic, but most AI minidramas still rely on fully AI-generated characters. "At the end of the day, cost control is what matters most," Ma said.
The comment underscores a fundamental tension in the industry. Producers face pressure to deliver content at minimal cost and maximum speed. Licensing real faces adds a layer of expense and legal liability. If synthetic faces can be generated at zero marginal cost and audience complaints about homogeneity remain manageable, the economic incentive to license real faces weakens.
This dynamic may limit the long-term viability of face-licensing platforms. If only a small fraction of productions opt for licensed faces, the platforms will struggle to generate sufficient transaction volume to sustain operations. Meanwhile, users who upload their faces assume open-ended risks for modest, one-time payments.
Regulatory and Ethical Gaps
China's legal framework for AI-generated content is still taking shape. The Beijing Internet Court's March ruling established that unauthorized use of likenesses is illegal, but many questions remain unresolved. What constitutes sufficient authorization? How should platforms verify that uploaded faces belong to the uploading user? What remedies are available when licensed faces are misused or when biometric data leaks occur?
The platforms themselves operate in a regulatory gray zone. They facilitate transactions but do not produce content, making their liability for downstream misuse unclear. They offer monitoring and legal support, but these services depend on detection algorithms that can be evaded and legal systems that vary by jurisdiction.
From a policy perspective, face-licensing platforms reflect broader challenges in governing AI systems. The technology moves faster than regulation, creating gaps that market actors exploit. Individuals bear risks they may not fully understand, and enforcement mechanisms lag behind the pace of innovation.
The ethical dimension is equally complex. Proponents argue that face licensing gives people agency over their likeness and creates new income opportunities. Critics counter that the model monetizes vulnerability, offering modest payments in exchange for open-ended biometric exposure. The power imbalance between individuals and platforms, combined with vague contracts and limited oversight, suggests that many users may not fully grasp the long-term implications of uploading their faces.
What Comes Next
The face-licensing model is too new to predict its trajectory with confidence. If regulatory scrutiny intensifies or high-profile misuse cases emerge, platforms may face pressure to tighten authorization terms, improve monitoring, or limit downstream usage. Alternatively, if the model proves economically viable and legally defensible, it may expand beyond China to other markets where AI-generated content is growing.
For now, the platforms occupy a narrow window: demand for diverse faces is rising, legal precedents are emerging, and users are willing to experiment. But the structural risks, vague contracts, and cost pressures producers face suggest that this marketplace may remain niche or evolve in directions its architects did not anticipate.
